1 Acceptance of Terms

Welcome to Don't Crush the Baby! ("the Game"), developed and published by Jason Repac ("we," "us," or "our"). By downloading, installing, or playing the Game, you agree to be bound by these Terms of Service ("Terms").

If you are under 13 years of age, a parent or legal guardian must review and agree to these Terms on your behalf. We encourage parents and guardians to supervise their child's use of the Game.

2 Who Can Play

The Game is designed and rated for players of all ages, including children. It contains no violence, mature language, or inappropriate content. The Game is suitable for ages 0 and up.

Players under the age of 13 should play with the knowledge and approval of a parent or guardian. We do not knowingly collect personal information from children under 13 without verified parental consent.

3 License to Use the Game

We grant you a limited, non-exclusive, non-transferable, revocable license to download and play the Game solely for your personal, non-commercial entertainment.

You may not:

• Copy, modify, or distribute any part of the Game
• Reverse-engineer, decompile, or disassemble the Game
• Use the Game for any commercial purpose
• Remove or obscure any copyright or trademark notices

4 Privacy & Data Collection

We take your privacy seriously — especially for younger players. Please review our Privacy Policy for full details on what data we collect and how we use it.

In summary:

• The Game does not require you to create an account or provide personal information to play.
• We may collect anonymous usage data (such as gameplay statistics or crash reports) to improve the Game. This data does not identify you personally.
• We do not sell personal data to third parties.
• If the Game uses third-party analytics or advertising SDKs, those services have their own privacy policies. We only use services that comply with Google Play's Families Policy.

5 In-App Purchases

The Game may offer optional in-app purchases. All purchases are processed securely through the Google Play Store and are subject to Google Play's payment terms.

• All sales are final unless otherwise required by applicable law.
• Parents and guardians are responsible for any purchases made on a device used by a child.
• We recommend enabling Google Play's parental controls and purchase confirmation settings to prevent unintended purchases.
• The Game is fully playable without making any purchases.

6 Advertisements

The Game may display advertisements provided by third-party ad networks. Any advertising shown within the Game complies with Google Play's Families Policy and applicable child-directed advertising rules, including COPPA.

Advertisements shown to users in family-oriented contexts will be appropriate for all ages and will not include behaviorally targeted ads directed at children under 13 without verifiable parental consent.

7 Acceptable Use

You agree to use the Game only for lawful purposes. You must not use the Game in any way that:

• Violates any applicable local, national, or international law
• Attempts to cheat, hack, or exploit bugs to gain an unfair advantage
• Interferes with other players' enjoyment of the Game
• Transmits any harmful, offensive, or unlawful content

8 Intellectual Property

All content within the Game — including but not limited to artwork, characters, audio, code, levels, and the "Don't Crush the Baby!" name and logo — is owned by or licensed to Jason Repac and is protected by copyright and other intellectual property laws.

Nothing in these Terms transfers any intellectual property rights to you.

9 Disclaimer of Warranties

The Game is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Game will be error-free, uninterrupted, or free of viruses or other harmful components.

We reserve the right to modify, suspend, or discontinue the Game (or any part of it) at any time without notice.

10 Limitation of Liability

To the fullest extent permitted by law, Jason Repac shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Game.

Our total liability to you for any claim arising from these Terms or your use of the Game shall not exceed the amount you paid (if any) for the Game in the 12 months preceding the claim.

11 Parental Controls & Child Safety

We are committed to providing a safe experience for younger players. We encourage parents and guardians to:

• Set up Google Play parental controls to restrict purchases and downloads
• Review the Game's content before letting young children play
• Play alongside young children to monitor their experience
• Contact us with any concerns about content or safety

12 Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. If changes are significant, we will provide notice through the Game or on our website.

Your continued use of the Game after any changes constitutes your acceptance of the new Terms.

13 Governing Law

These Terms are governed by the laws of the jurisdiction in which Jason Repac operates, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the Game shall be resolved through binding arbitration or in the courts of that jurisdiction, as applicable.
